In a not so strange twist of events, Motorola ended up suing its former employee, Michael Fenger who is currently working at Apple. Michael Fenger was a Motorola executive until March and his job description involved among other things knowing Motorola’s business practice and policies for the Europe, Middle East and Africa regions.

After quiting his job with Motorola he was hired by Apple and joined the iPhone team as the vice president for global iPhone sales. Motorola is claiming he unlawfully applied for this job although he had a contract clause which forbids him to get a job for any of Motorola’s competitors before 2 years have passed since his resignation. Motorola claims that with his knowledge he helped Apple develop their iPhone sales place in those regions and thus he harmed Motorola.

As a logical consequence, a suit has been filed last Thursday in Illinois state court. Motorola wants Fenger to give $1 million back from stock options awards and to be banned from working with Apple for those two years.

Well Moto, shouldn’t you have done this back in March when it happened? Wouldn’t that have been more efficient. Isn’t it too late know to prevent him sharing any secrets regarding his area of expertise? Further more instead of going for lawsuits and what not, shouldn’t you be developing a viable device. It’s not like you have any strong handset out there at this time. And that’s surely not Fenger’s fault.
